DINBENT TERMS AND CONDITIONS OF USE

By accessing and using our website www.dinbent.com, You (“User” or “Customer”) agree to the rules of this document, signed between You and DINBENT EMPREENDIMENTOS. (“DINBENT” or “Us”).
1. Objective
Our goal is to ensure transparency in your shopping experience, always in compliance with current legislation.
By accepting the present Terms and Conditions of Use of DINBENT, you declare to be aware of and in accordance also with the content of our Data Privacy Policy.
2. About our E-commerce
When browsing our E-commerce, You will have access to all the products made available by Us, being able to carry out your search by browsing the available categories, which are subdivided into genre, type of product and others.
2.1. Product Information:
Accessing a specific product in our E-commerce, You will have access to the photos and relevant information about it, including descriptions, measurement tables, compositions, size, available colors and product functionalities, being able to evaluate all the information related to the product before completing your purchase.
2.2. Forms of Payment
You may choose to pay for your purchase according to the methods available on the website.
2.3. Confirmation of Purchase
After the payment is processed and approved, You will receive the order confirmation in the email/mobile registered by You on our website. The delivery time of the product starts counting only from this confirmation.
2.4. From the conclusion of the Orders
Dinbent has several logistics partners for deliveries to all locations. By accessing the “cart” step and entering the delivery zip code, you can have broad visibility into all conditions before your order is completed.
You will be able to choose the carrier that best meets your needs based on freight rates and delivery times.
DINBENT may, at its sole discretion, change the conditions of the free shipping benefit, including regarding the minimum amount required or applicable modalities, in accordance with promotions or campaigns made available on its website.
2.4.1. Of the Delivery procedures
The products will be delivered to the address indicated by You, therefore, it is important to pay attention to the details of the information.
Carriers make up to 3 (three) delivery attempts. If they are unsuccessful in any of them, the application will go back to DINBENT. In this hypothesis, o o o the order may be automatically cancelled, by refunding the amount paid or DINBENT may make an attempt to contact You to confirm the information and make a new delivery attempt.
In this scenario, the previously reported delivery time will be disregarded. We will inform You of a new deadline, which will be counted from the confirmation of the address data.
You are aware and agree that DINBENT has no responsibility for the actions or omissions eventually caused by the logistics partners.
2.5. From the exchange or return of the order:
It is possible to perform Order Exchange or Return in the following scenarios:
- Right to Regret: If you bought on our website and changed your mind, that's fine. Under the Right of Regret, guaranteed by the Consumer Protection Code, you can withdraw your purchase within 7 (seven) calendar days from the date of receipt of the product.
To do this, the product must be without signs of use and with the DINBENT label. Simply contact us through our official customer service channels and follow the guidelines of our Exchange and Return Policy;
- Defective Product: If your product arrived with a defect, don't worry. You can request the exchange or return.
The product must be free of signs of use and with the DINBENT label. Our team will evaluate the case and follow the procedures outlined in the Exchange and Return Policy.
Other hypotheses provided for in specific Policy: In addition to the scenarios described above, all other situations covered in DINBENT's Exchange and Return Policy also apply.
3. OF THE "ANTI-FADEDNESS" GUARANTEE:
DINBENT ensures that products do not fade quickly after proper use. This guarantee is valid for a period of 1 (one) year counting from the receipt of the product.
If your product shows fading before this deadline, You can activate our service channels, observing the procedures below and those set out in our Exchange and Return Policy.
- What is fading?
It is the gradual and uniform loss of color over time, with use. In this scenario, the prout may undergo a change in its color (in intensity or hue). This change can be verified by technical methods involving qualitative and/or quantitative analyses.
4. Applicability of the Guarantee:
The warranty will apply as long as the usage process strictly follows the instructions set out on the labels or on the DINBENT website:
a) Do not soak, twist or bleach;
b) moisturize leather materials, do not use a drum/dryer;
c) dry clean;
4.1. Non-applicability of the Guarantee
It is the natural loss of excess dye due to misuse or improper washing of the material.
Misuse can distort products in their entirety and quality, which increases the likelihood of product quality loss.
DINBENT is not responsible for any damage or stains caused to other products as a result of the phenomenon of misuse
- Product changes resulting from misuse:
Our products must be kept in dry places washed and handled according to the instructions of the label, website and other media outlets of Dinbent.
Products that undergo a change in color due to contact with inappropriate chemicals (e.g., bleach, fat, rust, paint, tomato sauce, among others) will not be considered for warranty purposes.
4.3. From the claim of fading and testing
DINBENT In the fading claim scenario, we will continue with the analysis, using exclusively our technological and testing criteria in order to evaluate any change in color.
5. OF INTELLECTUAL PROPERTY
The elements and/or tools found on the DINBENT website are subject to intellectual rights in accordance with Brazilian laws and international treaties and conventions to which the United States is a signatory. For example, the following are understood as such: texts, software, scripts, graphic images, photos, sounds, music, videos, interactive resources and similar, trademarks, service marks, logos and "look and feel", among others, belonging exclusively to DINBENT.
Users are aware of and agree that the use, redistribution, commercialization and/or reproduction of content or part of content made available on the Platform must follow the rules concerning Brazilian Copyright laws, under penalty of characterizing improper use and/or violation of intellectual rights of third parties.
6. Gift Card from Dinbent
6.1. What is the Dinbent Gift Card?
The Gift Card Dinbent is a gift card, issued and managed by Dinbent, which grants its holder the right to purchase products on the website https://www.dinbent.com/ in the nominal amount of the amount loaded. It is an electronic, virtual and non-refundable payment method, intended exclusively for the purchase of goods on Dinbent's e-commerce site. The Gift Card will be sent by email to the recipient (gift recipient) indicated by the purchase holder (User), containing a unique code to be used in the shopping cart.
6.2. From acquisition and purchase limits
Mandatory Individual Purchase: The Gift Card must be purchased in an individual and exclusive order, and the inclusion of any other products from the store in the same cart is prohibited.
Purchase Limit per User: The maximum limit of 01 (one) Gift Card(s) purchase per user (CPF) is established for each period of 24 (twenty-four) hours.
Discount Restrictions on Purchase: The Gift Cards amount is not eligible for the promotional discount.
6.3. Shipping and Scheduling
Payment Confirmation for Shipping: The sending of the Gift Card code to the recipient's (gifted) email will be processed only after full payment confirmation by the purchase holder's financial institution.
No Change of Recipient Email: The recipient's (gifted) email, as informed at the time of purchase, cannot be changed after the order is finalized.
Rule for Scheduled Shipping: In cases of shipping scheduling, the email containing the Gift Card will be dispatched by 10:00 am (ten o'clock in the morning) on the date selected by the purchase holder (User).
6.4. Of Validity and Use
Validity: The virtual Gift Card is valid for the non-extendable period of 12 (twelve) months, counting from the date of its receipt in the recipient's email. After this period, the remaining balance will be automatically expired, without the right to any reimbursement.
Non-Refund and Non-Return: The Gift Card cannot be returned, exchanged for cash or refunded under any circumstances, after the purchase has been completed and shipped, however, the Purchase Holder has a period of 7 (seven) calendar days to withdraw from the purchase, counting from the receipt of the product, in accordance with the Consumer Protection Code, only in the event of non-use of the Gift Card balance by the recipient in this period.
In-Use Discount Restrictions: Discount or promotional coupon codes cannot be applied to orders paid in full or in part with the Gift Card balance.
From the use of the Gift Card: To use the Gift Card, the gift recipient must be in accordance with the present Terms and Conditions of Use of Dinbent.
6.5. From Resale Prohibition and Fraud Cancellation
Resale Ban: Reselling of the Gift Card Insider, which is intended solely for the use of the gift recipient in the brand's official e-commerce site, is strictly prohibited.
Cancellation due to Fraud: Insider reserves the right to cancel the Gift Card code immediately and without prior notice if it is found that its acquisition or use resulted from a fraudulent, illicit means, or violated these Terms and Conditions, without prejudice to applicable legal measures.
Buyer's Responsibility: The responsibility for the safekeeping, secrecy and use of the Gift Card code is exclusive to the buyer and/or recipient from its receipt.
6.6. Closing of Product Gift Card
Closing and Prior Notice: Dinbent reserves the right to close the Gift Card product at any time without notice. In the event of product closure, for Gift Cards with remaining balance, Dinbent Empreendimentos may generate coupons for the residual value if they are still in effect, at its sole discretion and as an exception.
6.7. Application of the Terms and Conditions of Use
The use and acquisition of Gift Card Insider, either by the Original Buyer or the Recipient/Giftee implies acceptance and full submission to these specific Gift Card Terms and Conditions, as well as to all General Terms and Conditions of Use of the Website (E-commerce) and Dinbent's Privacy Policy.
6.8. Prevalence of the Specific Rules
In the event of a conflict or divergence between the General Terms and Conditions of the Website and the specific rules detailed in the Gift Card section, the latter will prevail with regard exclusively to the purchase, validity, use and restrictions applicable to the gift card.
7. Of Terms and Conditions of Use
To make a purchase on DINBENT's e-commerce, You must be over 18 (eighteen) years old.
If you are a minor or civilly incapacitated, the purchase must be made with the supervision of your legal representatives. In addition, it will be necessary to provide some personal data to complete the purchase, as explained in our Privacy and Data Security Policy.
DINBENT carries out the processing of Users' personal data in compliance with the General Data Protection Law and other applicable standards, as provided for in our Privacy and Data Security Policy.
By using our website and/or purchasing the products, You represent that you have read and accepted these T & C and the Privacy and Data Security Policy. These documents have the force of contract and by accepting them, You will be legally obliged to comply with its provisions.
- Account blocking hypotheses:
By using the DINBENT website, the User undertakes to act ethically, responsibly and in compliance with American legislation, as well as our Privacy and Data Security Policy.
Dinbent may deactivate, block or terminate your access to our website by unilaterally terminating this contract if:
(i) any violation of the law or these T&Cs;
(ii) practice of fraudulent acts in the use of e-commerce, directly or indirectly;
(iii) damages caused by the customer, direct or indirect, to DINBENT;
(iv) customer default, characterized by non-payment of any amount due under agreed terms;
(v) in other situations that, at DINBENT's discretion, are necessary due to violation of legal standards, incompatibility with company policies, or other relevant reasons.
- Of the Changes
The T & Cs may be amended at any time, whether for legal or strategic reasons. You acknowledge and agree that it is your sole responsibility to periodically check the updated version of the T&Cs at the address above.
We may, under our sole discretion, communicate significant changes, but this liberality does not replace your responsibility to monitor any changes.

- Applicable Law and Jurisdiction
This T&C is governed and interpreted by American laws.
Any and all conflicts regarding the interpretation of these Terms will be resolved exclusively in the forum of the User's place of residence, with express waiver of any other, however privileged.
